Terms & Conditions

1. Booking & Deposit

• 1.1 A 30% non-refundable deposit is required to secure all bookings.
• 1.2 The deposit will be deducted from the final balance.
• 1.3 Deposits are transferable to a new date only where a minimum of 72 hours' notice is provided.
• 1.4 Cancellations or rescheduling requests made with less than 72 hours' notice will result in loss of the deposit. A new deposit will be required to secure a new date.

2. Payments

• 2.1 The remaining balance must be paid no later than 24 hours prior to the scheduled shoot date.
• 2.2 Failure to pay the remaining balance may result in cancellation of the shoot, with the deposit retained.
• 2.3 Accepted payment methods will be confirmed at the time of booking.

3. Pre-Shoot Requirements & Health Disclosure

• 3.1 Clients must disclose all known allergies, sensitivities, skin conditions, or medical conditions relevant to hair, makeup, or skincare products prior to the appointment.
• 3.2 Moments by Montrose and its team will not be held liable for reactions or outcomes resulting from undisclosed information.
• 3.3 Clients must arrive with freshly washed and fully dried hair and no makeup applied, unless otherwise agreed in writing.

4. Changes, Cancellations & Rescheduling

• 4.1 All rescheduling requests must be submitted in writing and are subject to availability.
• 4.2 In the event of illness, severe weather, or circumstances beyond the Studio's reasonable control, Moments by Montrose reserves the right to reschedule without penalty.
• 4.3 If Moments by Montrose is required to cancel, all fees paid will be refunded in full unless an alternative date is agreed.

5. Image Delivery

• 5.1 Final edited images will be delivered within the agreed timeframe.
• 5.2 RAW or unedited image files are not included.
• 5.3 Number of edited images corresponds to the package purchased. Additional images may be purchased separately.
• 5.4 Images will be stored for no longer than three (3) months from the shoot date.

6. Copyright & Usage Rights

• 6.1 All photographs remain the copyright of the photographer.
• 6.2 The Client is granted a non-transferable licence for personal use only.
• 6.3 Images may not be sold, edited, filtered, altered, or used commercially without written consent.
• 6.4 Moments by Montrose may use images for portfolio, website, social media, marketing, and promotional purposes unless opted out.

7. Conduct & Responsibilities

• 7.1 Clients must arrive on time; late arrival may reduce shooting time without refund.
• 7.2 Children and pets must be supervised at all times.
• 7.3 Moments by Montrose is not responsible for loss or damage to personal belongings.
• 7.4 Clients are responsible for providing their own outfits and accessories unless agreed otherwise.

8. Liability

• 8.1 While all reasonable care is taken, Moments by Montrose is not liable for loss of images due to equipment failure, data corruption, or circumstances beyond reasonable control.
• 8.2 In the unlikely event images are lost or unusable, liability is limited to a full refund of monies paid.
• 8.3 Nothing in this agreement limits or excludes liability for death or personal injury caused by negligence or any matter that cannot be excluded under UK law.

9. Makeup, Hair & Photography Consent

I voluntarily consent to receive professional makeup, hair, and photography services provided by Moments by Montrose. I understand that outcomes vary depending on skin type, hair type, condition, lighting, and artistic style.

10. Editing & Artistic Control

I understand and agree that all images will be edited at the Studio's discretion. Editing decisions are subjective and made to the Studio's professional and artistic standards. Final images will be delivered edited to the Studio's satisfaction, with no guarantee of further alterations unless agreed in writing.

11. Data Protection (UK GDPR)

Personal data is processed in accordance with the UK GDPR and Data Protection Act 2018. Personal information is used solely for booking management, service delivery, communication, and legal obligations. For full details see our Privacy Policy.
